
You know, I haven't filed my tax return this year, or last year. Can I still file bankruptcy? The good news is, you don't need to have filed your tax returns in order to actually go into bankruptcy and get the benefits of the automatic stay and get that process started, but in a Chapter 13 case you've got to have filed the last 4 years before the bankruptcy; and, in a Chapter 7 case, the trustee might say, no, we don't think you should be in bankruptcy, because we can't verify what your tax obligations are, because you haven't filed. Chapter 7 is a little bit more leeway than Chapter 13, but the important thing is you don't need to have your taxes filed to get the benefit of the automatic stay, but you should expect that you're going to have to get your taxes done in order to get all the benefits you can get under the bankruptcy system.
